Limited Searches and Finding Prior Policies
Limited title searches are becoming increasingly common in both residential and some commercial real estate closings, and are now nearly the standard. Options for limited searches include updating a prior owner’s policy or loan policy, conducting deed-out developer searches, back title letters, deed searches from national or regional homebuilders, current owner searches, and various other alternatives. These options can streamline the search process and reduce costs for consumers. However, opting out of a full search introduces additional risks to clients, some of which may not be covered by title insurance policies.
Join us for a discussion with LM Title staff attorneys as we explore the availability of limited title searches among various title underwriters in North Carolina. We will also cover the practical considerations and ethical challenges attorneys and paralegals face when determining if a limited search is appropriate for a particular transaction. Finally, our Prior Policy Team will share valuable tips on how to maximize the chances of locating a prior policy.
