Mechanic's Liens

This CLE presentation provides a comprehensive, practice-oriented overview of mechanic’s lien law, with a focus on protecting and enforcing payment rights in construction and real estate disputes. The course walks participants through the full lifecycle of a mechanic’s lien—from statutory prerequisites and notice requirements, to lien filing, perfection, priority, and enforcement —highlighting common pitfalls that routinely result in lost or subordinated lien rights. Particular emphasis is placed on the interaction between lien claims, payment bonds, deeds of trust, and foreclosure proceedings, as well as strategic considerations when representing owners, general contractors, subcontractors, and suppliers. Attendees will gain practical guidance on timing traps, drafting considerations, lien waivers, defenses, and litigation strategy, along with real-world examples drawn from active construction disputes. The program is designed to equip practitioners with the tools needed to evaluate lien viability, advise clients early, and aggressively protect payment rights in high-stakes construction matters.

R. Lee Robertson, Jr. is managing partner for Robertson & Associates PA located in Charlotte. Lee focuses his practice on Commercial Litigation, Construction Law, and Employment Defense. Mr. Robertson is regarded as an expert in North Carolina lien law and regularly provides continuing education seminars and training to other lawyers about the application of North Carolina’s technical lien statutes.
